The Guardian has recently uncovered audits and whistleblowing reports from factories that supply the fast-fashion retailer Boohoo. All 18 audit reports raised questions about minimum wage violations at the time they were conducted. Issues identified in these supplier audits include inaccurate hours recorded for workers potentially resulting in workers not receiving the minimum wage or their furlough money, workers not having the right to work in the UK, and employees being issued with contracts that aren’t in their native language amongst others.

UK's largest pension schemes set for mandatory climate risk reporting
A six-week consultation on new climate disclosure rules for the UK’s pension sector started on 26th August. Under the proposed changes, pension schemes with £5bn or more in assets under management will be required to both assess and publicly report on the physical and transition risks facing assets in their portfolios by the end of 2022.
Smaller schemes which still have more than £1bn of assets under management would then be subjected to the same requirements by the end of 2023. To ensure that disclosures are uniform, pension schemes will be mandated to follow the recommendations of the Taskforce on Climate-related Financial Disclosures (TCFD).
According to the Department of Work and Pensions’ Secretary of State, once this roll-out is complete, 70% of the UK’s pension sector, in terms of assets under management, would be covered.
New guidance for protecting migrant workers during the coronavirus pandemic

China: Investigation finds labour abuse & sexual harassment at toy factories producing for international brands; Includes company responses
In November 2019, labour rights NGO China Labour Watch (CLW) released a report raising allegations of labour abuses faced by workers at five factories producing for international toy brands in Guangdong Province, China. Abuses documented by CLW include low wages, excessive overtime, inadequate health and safety protections, poor living conditions in worker dormitories, restrictions to freedom of association, discrimination, sexual harassment and gender-based violence. Brand companies (including Disney, Lego, BuzzBee etc.) are taking actions.

Chinese Govt releases regulation on guaranteeing wages for migrant workers
Premier Li Keqiang has signed a State Council decree to publish a regulation on guaranteeing payments of wages to rural migrant workers. The regulation requires market entities should take the lead under the supervision of government and society including labour unions, social medias etc. It states employers must pay employment wage in full and on time through bank transfers or cash. It also clarifies the responsibilities of employers for paying off arrears to migrant workers and corresponding legal account abilities for any breach of the regulation. This regulation will go into effect on 1st of May, 2020.

Delhi factory fire: More than 40 dead in India blaze
A large fire has swept through a bag factory in the Indian capital Delhi, killing 43 workers. A local fire chief claims that the building did not have a proper fire licence and was operating illegally as a factory. The owner of the factory has been arrested. An electrical short circuit may have caused the fire.
Latest UN Emissions Gap Report finds world must ramp up climate ambitions at least threefold to meet Paris goals
The Emissions Gap Report 2019 finds that total greenhouse gas emissions have risen by 1.5 percent per year over the past decade, and that even if all current commitments made under the Paris Agreement were implemented, global temperatures would rise by 3.2°C. Countries would have to ratchet up their emissions reductions commitments threefold to meet the 2°C target by 2030.To reach the 1.5°C target, it would require a five-fold increase in countries’ emissions reduction commitments.
U.S. blocks import of goods from five nations in rare anti-slavery crackdown
The US Customs Border Authority has banned the import of products from certain companies accused of modern slavery violations. The law came into effect in 2016 but this action shows that it can have teeth.
One of the five products/companies was a garment factory in Xinjiang, China, and another one a Malaysian rubber glove factory. The latter was accused of withholding wages, excessive recruitment fees and withholding of passports in a Guardian report back in December 2018 here.
A call for EU human rights and environmental due diligence legislation
Early December, over 100 NGOs, trade unions and networks stress their demands for binding rules on corporate respect for human rights and the environment. They point out that although some companies are taking actions to meet their responsibilities in their global operations, there are many others linked to serious abuses, including modern slavery, gender discrimination, corruption, deforestation, etc. Current EU policy and legislation fails to adequately address this challenge. They propose that 1) companies and investors are required to carry out human rights andenvironmental due diligence; 2) new binding EU legislation that increases protection for individuals and communities, workers and their representatives, human rights defenders, and the environment, is passed.
Amazon probe into illegal teen workforce
Amazon is investigating the working practices of one of its key suppliers in China - Hengyang Foxconn factory after they were found to have illegally recruited hundreds of student interns aged 16-18, many of whom were also working overtime. These students worked long hours to meet production targets. Those working overtime were only paid the normal hourly rate instead of time-and-a-half which is required by Chinese law and by Amazon’s own supplier code of conduct.
China Employment Law Update June 2019
China has taken further steps to reduce the burden of social insurance on employers by implementing new policies and rules. On production safety, the government issued a policy titled ‘Measures on Coordination Between Administrative Enforcement and Criminal Proceedings in Production Safety Crimes’, which will mean tighter enforcement in this area. Some new updates on workplace sexual harassment and personal data protection have also been put forward by government. Employers are asked to review these newly issued policies and any forthcoming national and local policies to ensure their practices are in line with the regulations.
India ruling could allow millions of home workers to access benefits
India's top court instructed a garment firm to pay pensions to women who had worked for them from home in the 1990s. There are an estimated 37 million home-based workers across various sectors in India. Besides being denied minimum wages, home-workers get no social security or medical benefits from employers and have virtually no avenue to seek redress for abusive or unfair conditions. The new ruling could set a precedent, helping millions of "invisible" workers access staff benefits.
NGO's softly-softly tactics tackle labour abuses at Malaysia factories
An 18-month investigation conducted by Transparentem unearthed serious abuses at five apparel factories in Malaysia – hundreds of migrant workers had paid illegal recruitment fees that sometimes exceeded a year’s pay, while four of the factories retained the workers’ passports. The findings were presented to 23 western companies, fifteen of whom agreed to help remediate the five factories by defining specific resolutions. In addition, the American Apparel and Footwear Association – which includes Nike, Gap, Ralph Lauren and 120 other companies – announced a new policy on “responsible recruitment” that requires “supply chain partners” to make sure no workers pay recruitment fees and “workers retain control of their travel documents and have full freedom of movement”.

China launches widespread safety probe after deadly chemical blast
An explosion at a pesticide plant in eastern China's Jiangsu province killed 78 people and injured more than 600. The government has since launched a nationwide inspection into hazardous chemicals, mines, transportation and fire safety. The area's environmental protection bureau has implemented an emergency plan to remove and treat toxic wastewater from a nearby river, with concentrations of harmful chemicals like benzene well past safe limits. The Chinese government vowed to tighten environmental impact assessment approvals for chemical plants and enhance daily inspections. It has also said it will revise the Production Safety Law this year in response to the explosion.
Jiangsu’s provincial government also have plans to close thousands of chemical production sites and chemical parks over the next three years.

Tea label giants vow probe after Sri Lanka labour abuse exposé
An investigation by the Thomson Reuters Foundation found that some workers at tea estates certified by Rainforest Alliance and Fairtrade in Sri Lanka suffer from illegal wage deductions and take home as little as 14 U.S. cents a day. Rainforest Alliance and Fairtrade said they were investigating as deducting wages without workers' consent was not allowed by law and contravened their standards. Unilever said it was "deeply concerned" and would investigate. Major tea company Tetley, owned by India's Tata Global Beverages, said it was in touch with the Rainforest Alliance regarding the findings.

Standard on Major Hazard Installations for Hazardous Chemicals to Take Effect in March 2019
On November 19, 2018, Chinese State Administration for Market Regulation and Standardization Administration announced the release of the revised Identification of Major Hazard Installations for Hazardous Chemicals (GB 18218-2018). It came into mandatory effect on March 1, 2019. Major hazard sources in printing industry may include the inflammables and explosives, such as methylbenzene and ethanol used in printing ink, cleansing solvent, as well as VOC that may lead to serious disease.
Canadian Modern Slavery Act
A private member's Bill was introduced in Canada to introduce mandatory company reporting on childlabour and modern slavery through the imposition of certain measures and amending the Customs Tariff. The draft can be found here. It now requires government approval to pass.
Australian Modern Slavery Act
The Australian Modern Slavery Act passed in December 2018. The Act sets a Modern Slavery Reporting Requirement to require certain large businesses and other entities in Australia to make annual public reports - Modern Slavery Statements - on their actions to address modern slavery risks in their operations and supply chains.

Eleven Chinese workers arrested and 40 on the run after death on Japanese construction site
Japanese police are investigating a possible human trafficking operation after arresting 11 Chinese construction workers at a solar power plant over visa violations and finding another 46 have fled. The case comes as Japan faceslabour shortages owing to an ageing population and political discussions are now considering legislation to allow more foreign workers.
China closing all paper mills on Dongting Lake by end 2019
In a bid to clean up China’s second largest freshwater lake, local authorities in Hunan Province will close all pulp and paper mills around Dongting Lake by the end of 2019. The c18,000 people employed in the Province's pulp and paper industry will be supported by the local authorityin to new employment. This move is part of wider water pollution controls active since 2006 in Hunan Province. They have led to closures of over 200 waste paper pulping factories and 30 pulp and paper making facilities. The efforts to restore the lake over the past 40 years have helped it extend its area by 30%, providing better flood resilience in the region.
Malaysia keen to resolve worker crisis
Malaysia has shown positive intent to resolve the Nepali migrant worker crisis. The crisis started after Nepal government shut dubious visa processing agencies that illegally charged fees from Nepali workers. Both parties discussed about the probability of some temporary arrangement for the departure workers already cleared by the Malaysian Immigration and who have paid for Immigration Security Clearance and biometric identification test. The Malaysian government plans to introduce reforms in migrant labour sector. Malaysia will move ahead at the ministerial level after discussions end with clarity. It will hold another round of consultations with labour source countries to resolve all issues.

Asian factory workers face slavery risks with rise of automation in manufacturing: analysts
The rise of robots in manufacturing in Southeast Asia is likely to fuel modern-day slavery as workers who end up unemployed due to automation face abuses competing for a shrinking pool of low-paid jobs in a “race to the bottom”. Especially, the workers in Cambodia, Indonesia, Thailand, Vietnam and the Philippines — at least 137 million people — risk losing their jobs because of the automation in the next two decades. Those workers are more vulnerable to workplace abuses as they jostle for fewer jobs at lower wages.
Indonesia’s Order to Foreign Workers: Learn the Language
Indonesia is making it easier for foreigners to work here — but they will have to study as well. A decree by President Joko Widodo that is set to take effect on June will simplify Indonesia’s procedures for issuing work permits to foreigners, which are often hampered by delays, arbitrary denials and revocations, not to mention compulsory bribes to civil servants just to stamp the paperwork. Buried inside the order is a section requiring all expatriate workers to undergo formal Indonesian language training, an apparent first for any nation in Southeast Asia. The foreign business community has been caught off guard by the new requirement.
Abuse is daily reality for female garment workers for Gap and H&M, says report
Pressure to meet fast fashion deadlines is leading to women working in Asian factories supplying Gap and H&M being sexually and physically abused, according to two separate reports published by Global Labour Justice on gender-based violence in garment supply chains. More than 540 female workers at factories that supply the Gap and H&M have described incidents of threats and abuse. The reports claim that these allegations recorded between January and May this year in Bangladesh, Cambodia, India, Indonesia and Sri Lanka, are a direct result of pressure for quick turnarounds and low overheads. Gap and H&M are going to investigate the allegations and they welcome initiatives to tackle violence, including an ILO convention.

The challenges of recruiting and retaining staff in the publishing industry in China
The article introduces the shortage of skilful (mid to high level) workers in printing industry due to the decreasing graduates in this major from universities and vocational schools in China. Universities and vocational school has less students applying for the printing major, some universities have even cut out the printing major, while the others try to change the name of the major from ‘printing’ to ‘digital media’, ‘image propagation’ and ‘propagation engineering’ but still losing attraction to young people.
The main reason is the overall attraction of the labour-intensive manufacturing industry is decreasing in China due to the rise of internet and service industries, which means more opportunities for young people. The stereotype of printing industry is another reason. Although printing industry is moving forward into digital era, in many people’s mind, printing industry is still a ‘uncool’ traditional industry lagging behind, plus the recent increasing news on its environmental impact since the new environmental protection law, the industry’s image needs to be improved. The last reason is the most practical one – average salary level of printing industry is not competitive compared to other industries. The article gives some statistics: in 2016, the average employee salary of 8,936 publication printing companies is RMB 3,742/month, which is lower than the national average level in all industries (RMB 4,783). Even for the senior management, the salary is not competitive compared with the internet and finance industries.

Recalcitrant printing firm fined for pollution
Printing company Tat Seng Packaging Group (Singapore) pleaded guilty to three counts under the Sewerage and Drainage (Trade Effluent) Regulations and was fined in January $4,000 on each count. Another charge was taken into consideration during sentencing.
It had been caught four times for polluting Singapore's sewers with toxic industrial used water. But that did not stop printing company Tat Seng Packaging Group from illegally discharging copper-tainted water yet again in September 2016.
Apple: Human Rights Violations in Supply Chain Double in a Year, Report Reveals
Labor and human rights violations in Apple’s global supply chain have doubled in the span of a year, a new report has revealed. The company’s Supplier Responsibility Progress Report, released on Wednesday, detailed several “core violations” that were discovered following an audit of the working conditions of its supply chain employees across 30 countries. Apple trained more than 3 million supplier employees on their rights last year and tracked the working hours of 1.3 million people on a weekly basis.
Abuses included labor violations, the falsification of working hours, harassment and underage staff. Apple conducted 756 audits in total and its report detailed some of the violations that were considered to be “serious breaches of compliance.”
Launching of Promising Future Project for Suppliers in Book Chain Project
Promising Future Project will be lunched in February in 2018 for suppliers in Book Chain Project. Promising Future Project is a 10-brand initiative carried out in 2016 and 2017 to promote interest in China’s social insurance scheme by factory workers. The project was created and delivered by Carnstone Asia, and supported by the Ethical Trading Initiative’s Hong Kong office. Oil Tanker Spill Off China May Have Lasting Environmental Impacts
An Iranian oil tanker that collided with a Hong Kong bulk freighter in the East China Sea is creating a new problem now that it has sunk. The oil tanker was carrying close to 150,000 tons of condensate, a light oil, when it crashed. It is unclear how much of the oil had burned off or spilled when it sank. Unlike crude oil, which can create chronic environmental problems by sinking to the deep ocean and lingering there for years, hydrocarbon condensate is much lighter, evaporating or dissolving into water. That means short-term toxicity might be a bigger concern with this spill.

New Mapping Tool Links Chinese Factory Environmental Impact to Brand Name Retailers
the Natural Resources Defense Council (NRDC) in the U.S. and the Institute of Public & Environmental Affairs (IPE) in China launched the IPE Green Supply Chain Map, the only tool in the world to openly link leading multinational corporations to their suppliers’ environmental performance. H&M Group and WWF announce new initiative to help Turkey tackle its water challenges
During a high-level session at World Water Week in Stockholm, H&M group and WWF announced a new initiative to help Turkey tackle its water challenges, particularly pollution, and ensure sustainable, clean water supplies for businesses, people and nature. The project will focus on improving water management methods and policies in in the Büyük Menderes river basin, which is home to large-scale agriculture and industry, including textile operations, as well as rich biodiversity.

H&M, Zara and Marks & Spencer linked to polluting viscose factories in Asia
Major fashion brands are sourcing viscose from factories in China, Indonesia and India which are polluting and damaging health, according to new report. The report cites evidence that carbon disulphide exposure is harming both factory workers and people living near viscose plants. Residential areas nearby the factory are polluted with carbon disulphide levels three times higher than the permitted limit. The report is calling for carbon disulphide to be completely eradicated from the viscose production process, and for all viscose production to occur in a closed loop system which eradicates chemical discharge and prevents harm to workers and the environment. Spokespeople from those brands said they will work continuously with its suppliers to improve conditions and ensure that they adhere to sustainable practices.
Workers claiming they had to sleep with the chickens face Thai court charges
Burmese migrants charged with defamation after alleging labour abuses in Thailand’s multimillion-pound poultry export industry. The Burmese migrants allege they were forced to work 22-hour days at Thammakaset Farm 2, at times having to sleep in the chicken sheds with 30,000 hens. They also said their freedom of movement was severely restricted. Thailand’s important and well publicised efforts to systematically address migrant worker exploitation are seriously undermined as migrants cannot speak up.

China is cutting the number of products whose manufacturing requires official licensing. The 19 categories include water pipes and rechargeable batteries. The manufacturing licenses required for electric blankets and helmets for motorists are giving way to China Compulsory Certification. It is pivotal to the upgrading of the real economy and pose higher requirements to enterprises to ensure the quality of products.
Thousands Protest Chemical Plant Pollution in China's Hebei
Thousands of angered villagers protested in the northern Chinese province of Hebei on 3 May after a leak at a chemical plant called Hebei Xingfei Chemical Co. factory near Xingtai city releases toxic gases into the air. Residents of several villages near the site reported vomiting and fainting, while thousands have gathered outside the factory gates, blocking the road and demanding the plant's relocation for the past few days. Local officials have called on protesters to wait for environmental tests to be completed before they take a decision about how to deal with the factory.
Fire at ink factory
A major fire broke out at a printing ink manufacturing factory in Athipet near Ambattur Industrial Estate in India on 23 April. As the factory contained a large stock of chemicals, the raw material for manufacturing ink, the fire and rescue services personnel found it difficult to immediately douse the fire. The fire was brought under control after more than three hours of struggle.
Aldi contractors ‘treated like slaves'
Two former subcontractors allege they were exploited and underpaid while working at an Aldi warehouse in Brisbane for a period of five weeks 18 months ago. These two staff were hired through recruitment agency, and were made to work excessive overtime with flat rate. They were also told to stay in accommodation at Chermside (in Brisbane’s north) and were picked up and driven to the site, and all accommodation and travel costs would be taken out of their pay. ALDI says it is investigating the allegations.
Environment inspectors locked in by factory boss
An unannounced inspection by officials from China’s top environment watchdog at a factory in eastern China ended with an unexpected turn of events for all involved, as inspectors were obstructed from performing their duties and later blocked from leaving. The incident happened at a furnace maker in Jinan City, Shandong province, called Shandong Lüjie Environmental Protection Energy Saving Technology Co. Ltd. The manager identified had stopped the team from doing their work, citing “problematic” government identification cards, according to a statement on the Weibo microblog of the Ministry of Environmental Protection (MEP).
Unpicking parliament's new business and human rights report
The UK parliament’s Joint Committee on Human Rights has just published its Human Rights and Business 2017 report calling for “stronger legislation, stronger enforcement and clearer routes to justice” to protect workers’ human rights. ETI gave written and oral evidence to the Joint Committee on Human Rights for the report – and helped facilitate the committee’s visits to Turkish and Leicester garment supply chains, which were used as case studies.
Co-op provides hope for victims of ‘barbaric’ modern slavery
The Co-op has announced to offer jobs to victims of the modern slave trade as part of a new scheme. The group has teamed up with charity City Hearts, which offers support and accommodation to vulnerable people, to provide 30 survivors of modern slavery with paid work experience in its food business. Following the placement, the survivors will be given a non-competitive interview and, if it is successful and a position is vacant, be offered a job.
H&M plans proper pay structures, worker committees in garment factories by 2018
H&M is planning to have elected committees and proper pay structures for workers in its main supply factories across the world by 2018 in a bid to curb labour exploitation. By setting up these goals, the company is planning to work with its main suppliers to ensure wages for its 1.6 million garment workers are enough to afford a decent living and enable workers to raise their voices in a meaningful way with management by implementing capacity building programmes.
How high street clothes were made by children in Myanmar for 13p an hour
A new report revealed that children as young as 14 years old have been employed in garment factories in Myanmar supplying some of the most popular UK high street brands. Researchers also found overtime problem and wages below the full legal minimum at some of these factories. Brands have responded to the report findings, recognising the issues highlighted and promising to work with their suppliers on improvement.
Under 16 and working 16 hours a day ... Chinese clothes factories import cheap child labour from across China
Undercover investigation exposed a large portion of the more than 1,000 apparel manufacturers in Changshu, Jiangsu province, have been using cheap labour from Yunnan province with the help of local agents, and some of the workers are under 16. The workers are underpaid and forced to work for long hours. Forced labour practices such as violence and retention of identity documents were found.
Kids aged SIX making toys for Kinder Eggs as ‘slave’ workers are paid just 22p-an-hour for 13 hour shifts
The Sun reported that impoverished families in Romania were working long hours for little pay to make the toys at home for Kinder chocolate eggs. The Italian confectionery group Ferrero said on Wednesday it has launched an investigation into these allegations.
Samsung and Panasonic accused over supply chain labour abuses in Malaysia
Two of the world’s leading electronics brands, are facing allegations that workers in their supply chains are being duped, exploited and underpaid in Malaysia, after a Guardian investigation found that Nepalese migrant workers making goods for the global electronics brands claimed to be trapped and exploited. Both Samsung and Panasonic have said they are opening investigations into the conduct of their suppliers following the claims.
